Taking a realistic approach to trademark protection in the Gulf countries

Article Abstract:

International industrial property owners should be aware of how they can protect their trademarks from infringement in the six Gulf Cooperation Council (GCC) countries. Those countries are the United Arab Emirates, Bahrain, Kuwait, Oman, Qatar and Saudi Arabia. Registering trademarks in all six countries is the most important protective measure. However, a hypothetical example reveals the realities that limit copyright protection in GCC countries, such as their inexperience with conducting investigations of violations. Undeveloped case law and poor public awareness are also problems.

Local producer found guilty of trademark infringement in landmark Saudi case: Bettol producer drops civil suit

Article Abstract:

The Al Jazirah Factory for Cosmetics and Chemicals was found guilty of trademark infringement, in a criminal case brought by Saudi Arabia's Commerce Ministry, for passing-off a disinfectant called Bettol as the brand name Dettol. Reckitt & Colman, Dettol's manufacturer had reached a settlement in a civil suit brought in 1987. The case establishes passing-off as a cause for action in Saudi courts, and there is some indication that the Commerce Ministry is taking preventative steps against future cases of this sort.

Effects of recent amendments on companies in the kingdom

Article Abstract:

The Saudi Arabian Companies Law was amended Feb 3, 1992, and the Commercial Registration Code was amended Mar 22, 1992. These changes define when a royal decree is required for a joint stock firm, directorial board liability and conversion of company types. The Registration Code changes cover registration fee reductions for various types of companies.
