The law, its interpretation, levels of enforcement activity, and effect on employer behavior

Article Abstract:

Title VII of the Civil Rights Act of 1964 was interpreted in 1971 by the Supreme Court to protect disadvantaged groups from disproportionate employment practices, under the disparate impact theory. In 1989, the Supreme Court limited enforcement of Title VII, ruling that it could lead to the adoption of quotas. But the Civil Rights Act of 1991 wrote the disparate impact theory for protecting the hiring of disadvantaged groups into law.
