U.A.E.: amendment of armed forces tenders regulations

Article Abstract:

The UAE government recently introduced major reforms to the Armed Forces Tenders Regulations in an effort to clarify the procedures regarding the purchase and registration of tender documents. The new provision authorizes the Armed Forces to levy additional charges to applicants, if the preparation of documents involved greater amount than that of the original charge. Suppliers and contractors may also be requested to pay nominal costs involved in renewing or registering new applications.

Algerian state contracts: new scope, current practice; adapting to the demands of international trade

Article Abstract:

Public economic enterprises (PEEs) in Algeria are no longer considered state contracts for legal purposes. Because PEEs are legally independent of the state they have power to enter into contracts autonomously and their assets may serve as collateral for creditors. Algerian law has minimal effect on contracts, often mimicking French laws and allowing great scope in freedom of contract. The limited applicability of Algerian law, and new regulations concerning arbitration are discussed.

Abu Dhabi: Financial Supervisory Authority amendments

Article Abstract:

Abu Dhabi, United Arab Emirates has created the Abu Dhabi Law No. 2 of 1997 which modifies the statute that established the Financial Supervisory Authority. The new legislation obviously aims to liberalize the payment approval process by eradicating the preparatory assessment of contractual commitments. Nonetheless, it remains to be seen whether the new law will be successful in expediting payments to contractors since the contractors will still have to be approved by the Authority.
