Determining infringement by X-ray diffraction

Article Abstract:

X-ray diffraction analysis was used to determine in patent-infringement suit involving a SO(sub x) reducing additive admixed with a cracking catalyst. Zeolite was the catalyst while ceria was the additive. The two additives in the patent case was NO-SOX and NO-SOX-PC which were made by Intercat and used by Conoco Inc, two firms which were sued by WR Grace and Co. It was determined that five of the patents were infringed by two additives.

The important factors of the litigation process of testifying are presented in detail. The challenges involved in becoming a technical witness are also discussed along with list of three organizations in the United States that refer the experts to the lawyers.
