... And injustice for all

Article Abstract:

Several cases have been heard in the US courts relating to the position of members of the armed forces who are unable to sue the government if they are injured or killed outside active duty or training. All the cases have been considered to be an 'incident of service' even when they were unrelated to their duties as soldiers. The Feres Doctrine does not allow the soldiers to receive the level of compensation they would have been awarded in civilian life. 1st Lt. Rudolf J. Feres widow Bernice was unable to claim damages for the death of her husband in a fire at the Army barracks.
