Article Abstract:

A range of problems can arise in situations where health and safety law must be balanced against employment law. Under employment law, for example, employers are permitted to include working abroad and making business trips abroad in employment contracts, but employers should be aware that they must still meet their responsibilities under health and safety law if their employees are abroad. There can also be clashes between employment law and health and safety law in areas such as sex discrimination and incapacity.

Article Abstract:

The Management of Health and Safety at Work Regulations apply to product safety management as well as occupational safety management. Producers and suppliers need to comply with three requirements: make product risk assessments; establish and follow effective product safety measures and appoint product safety advisers. Non-compliance is a criminal offence. The burden on companies can be reduced by coordination and cooperation in the supply chain.

Crime and punishment

Article Abstract:

The provisions of the Health and Safety at Work (Offences) Bill 1999 are explained. The implications for employers and company directors are examined and the government proposals to introduce a wider, more stringent law are discussed.
