Federal appeals court says no to first amendment claim in telemarketing case

Article Abstract:

Dr. Jason Goodman, a chiropractor licensed in Illinois, wants to conduct telemarketing for his services, to open a clinic at Springfield. But Illinois Medical Act prevents medical professionals from soliciting patients. Dr. Goodman filed a First Amendment challenge to the law and requested preliminary injunction against Illinois Department of Financial and Professional Regulation (IDFPR). Seventh court turned down the plea as Dr. Goodman did not show that his telemarketing calls would be completely truthful.

The details of the legal case, involving general and vascular surgeon, Timothy Patrick, and physicians associated with Astoria Clinic, on grounds of violation of antitrust laws, by physicians, is presented. The legal battle had led to the creation of the Health Care Quality Improvement Act.
