Guidelines may focus stricter look at mergers

Article Abstract:

Recently released guidelines are unlikely to increase the number of government challenges to mergers and consolidations within the healthcare industry. Released in Apr 1992, the new guidelines specify the criteria to be used by the Justice Department and the Federal Trade Commission to determine whether a merger or consolidation threatens fair competition. The guidelines were written to be used to analyze the merger of any company, and federal regulators assert that the impact of the guidelines on healthcare companies will be minimal.

Bush task force proposes expanded fraud legislation

Article Abstract:

A Bush Administration task force consisting of officials from the Justice Dept, Office of Management and Budget and the Department of Health and Human Services has proposed stricter health fraud enforcement laws. The expanded fraud legislation covers a variety of issues, including creating new data banks to monitor all medical fraud investigations and enhancing existing self-referral and anti-kickback rules.

Justice, FTC seek rehearing of Marshfield antitrust case

Article Abstract:

The Federal Trade Commission and the Dept of Justice have filed briefs urging the appeals court to rehear a case between Wisconsin Blue Cross and Blue Shield and the Marshfield Clinic. Blue Cross/Blue Shield argues that the clinic acted as an illegal monopoly in blocking a Blue Cross HMO from entering the market.
