Article Abstract:

The recommended legislation on the reform of the Occupational Safety and Health Act will radically change existing laws especially with regard to the responsibilities of the Occupational Safety and Health Administration. A new body to be known as the Workforce Protection Standard Board will be tasked with the creation of standards while the enforcement of penalties will be greatly reduced and will come into force only when a serious accident occurs. This last-mentioned provision is the most controversial aspect of the proposed reform.

Courts set pace for new OSHA team

Article Abstract:

The Occupational Safety and Health Administration (OSHA) Review Commission, the Supreme Court for OSHA cases, has upheld the egregious-penalty or instance-by-instance penalty policy of the federal agency. Unlike the OSHA's previous practice of grouping similar violations together to create one single violation and therefore penalty, the egregious multiplier treats such violations as separate. This can mean millions of dollars in proposed fines foremployers violating OSHA regulations.
