Justice OKs doctor network outside antitrust safety zone

Article Abstract:

The US Dept of Justice waived antitrust guidelines and approved Allied Colon and Rectal Specialists, an Arizona physician network which comprises 78% of the specialists in their field in the Phoenix, AZ, market. The group had the support of area payers and is expected to increase efficientcy and encourage competition in the market. Also, the Justice Dept pointed out that many non-specialists perform colorectal surgical services in the area. This case sets a precedent because many lawyers interpreted the safety zone parameters as absolutes.

Vermont doctors to negotiate expenditure targets

Article Abstract:

The Vermont Legislature passed a universal-access health reform plan on Apr 25, 1992 allowing physicians to bargain collectively for health expenditures targets. The healthcare authority created by the bill will set expenditure targets in 1993, then use those targets to create a global budget in 1994. Physicians will be able to negotiate the targets before they become binding.

Networks still possible, with restrictions

Article Abstract:

A federal court has ruled that the Marshfield Clinic, a Wisconsin physician group, illegally engaged in monopolistic practices, but legal experts believe that physician groups can still integrate vertically. The ruling demonstrates how important it if for physician groups to adhere closely to antitrust laws and to seek clarification for difficult-to-interpret rules.
