Lurking liabilities: managed care can add an unforseen layer of risk. You can protect yourself

Article Abstract:

Physicians take on new risks and new responsibilities when they sign a managed care contract. The risks and liabilities of the managed care plan may not be covered by the physician's insurance, or the plan's rules could encourage poor medical practice. The law covering managed care plans is not well developed, so physicians need to take precautions. Before signing a contract, a physician should consult with an attorney, and be sure that any risk that is transferred is covered by insurance. The various types of liability arising out of managed care contracts are discussed.

Article Abstract:

The Military Entrance Processing Command unit enables physicians getting close to retirement to practice. The average age of these physicians is 65 and they work regular schedules without weekend or night duty. There are 68 centers throughout the US where about 400,000 complete physical examinations are conducted on new recruits in all five branches of the armed services. Physicians are excited by this service because they see conditions not always seen in their previous practices.

Beyond the fine print

Article Abstract:

A physician should take precautions including checking a managed-care provider's financial health, standards and market share before signing a contract. Also, a lawyer experienced in healthcare practice should be employed to check the terms of the contract. In addition, doctors associated with the provider should be asked for assessments of its operations. Lists of document types and sources of information about managed care plans are included.
