State law can determine force of 'noncompete' clause

Article Abstract:

Issues related to "noncompete" clauses and "restrictive settlements" are far from settled, although there have been many court decisions that can provide relevant precedents. Physicians in many states may be challenged in this area as the doctrines covering these issues are evolving in many states. The laws of the various states differ on how the courts may interpret a contract and construe them differently on their strictness and content.

Ask the right questions when facing restrictive covenants

Article Abstract:

The restrictions of postemployment for physicians is provided. It is important for employers to prove that the restrictions that have been enforced are legal. All restrictions, such as location restrictions, for a physician who plans to continue practicing in the location after his employment contract has terminated must be determined before the contract is signed or additional remuneration will be necessary.
