Conditional fees: the end of test cases in health and safety law?

Article Abstract:

Legal aid will probably not be available for personal injury cases in the UK from summer 1998. The government is aiming to reduce state support for litigation through by replacing the legal aid system with Conditional Fee Agreements. Lawyers fear that this change concerning personal injury will impede access to compensation for lower wage earners. The legal aid scheme allowed people who had suffered personal injury with an identifiable cause, to go to court knowing that they would not suffer financial loss. It also encouraged lawyers to take on test cases which have had a vital legal role.
