Pensions and policy: the ECJ's approach to pension schemes

Article Abstract:

The European Court of Justice (ECJ) must be commended for waging relentless efforts in extending equal treatment among pension organizations and the people covered by such schemes despite geographical and structural difficulties. The European authority has also made significant achievements in granting exclusive rights to pension funds and eradicating monopolistic competition within the region's pension markets. According to the ECJ, the issue whether competition regulations are applicable to pension scheme membership is in the jurisdication of national courts.

European Union: interpretation of the Safir Ruling

Article Abstract:

The decision of the European Court of Justice (ECJ) on April 28, 1998 involving the Safir case is expected to affect the cross-border provision of pensions in the European region. Observers believe that ECJ's decision, which cited a conflict between the Swedish tax legislation and the Treaty of Rome's provision involving the freedom to provide services, will promote cross-border provision of life assurance products. It also opens a possibility for a single insurer to render group life assurance to multinational firms in Europe.

The Schumacker and Wielockx cases: is the single market in pensions and life assurance coming soon?

Article Abstract:

Two cases decided by the European Court of Justice (ECJ) give an indication of how the single market in pensions and life assurance has progressed amid tax barriers set up by individual member-states. In the Schumacker and Wielockx cases, the ECJ stated that it was improper to treat a national of another member state less favorably than one of its own nationals. However, the ECJ has yet to issue a ruling against infringements with regard to freedom of services.
