Rejection of better qualified candidate is at least subconscious race discrimination

Article Abstract:

The decision of a Birmingham employment tribunal in the case of Sharma v. Handsworth Horticultural Institute Ltd. et al., is discussed. The application of Mr. Sharma, a man of Indian origin, for the position of a part-time secretary was rejected, and one Mrs. Pitt, a white woman was appointed. The tribunal found that Mr. Sharma had superior experience and qualifications when compared to Mrs. Pitt and concluded that there was race discrimination on the part of the respondents.
