Upper age limit of 65 unlawful

Article Abstract:

An legal case between Rutherford and another v Secretary of State for Trade and Industry (No.2) (3rd September 2004) wherein the Court of Appeal supports the Employment Appeal Tribunal's decision that no discrimination exists on the rights to claim unfair dismissal and redundancy pay as result of the statutory upper age limit of 65, is presented.

Implementing the EU race equality Directive

Article Abstract:

The European Commission has announced that it will initiate proceedings against five member states for failing to comply with the Framework Directive on racial discrimination (Directive2000/43). The deadline for complying with the Directive ended on 19 July 2003. The current situation in member states is examined in detail.

The European free Trade Association (EFTA) Vs Kingdom of Norway case probes the limits under European law of permissible positive discrimination in favor of an underrepresented group. The implications of the case resulted in adopting a rule reserving a number of academic posts exclusively for women.
