Environmental claims need careful site inspections

Article Abstract:

Insurers should inspect the site of environmental claims. Inspecting sites of environmental claims is important and is a simple procedure compared to other more technical procedures involved in environmental claims. An inspection team should include members who are familiar with coverage issues, who have technical expertise and who are professional photographers. The inspection is part of the discovery process, and evidence gathered can help a jury evaluate the condition of the site.

Oil tanks can leak red on company profits

Article Abstract:

The liability many insurance companies have for residential fuel oil spills could prove to be costly. Estimates of Northeast fuel oil cleanup costs range from $500 million to $8 billion through 2005. Insurers can help prevent costs from escalating by dealing with the problem quickly and efficiently and by having oversight over remedial contractors. Such oversight can be accomplished by contracting with environmental oversight companies.

On-line defamation is new cybertort issue

Insurers are becoming cognizant of tort liability issues concerning on-line defamatory messages. Internet liability, the prime focus of new defamation regulations, is the basis for two cases against major Internet access providers. The controversy centers around the degree to which on-line services should be held accountable for defamatory messages sent over public bulletin boards.
