Finding the limits of the defense universe

Article Abstract:

The California Supreme Court has ruled against Los Angeles Lakers basketball team owner Jerry Buss in the case filed against him by a litigation insurance company. The insurer had previously agreed to defend Buss from a litigation filed against him by an advertising agency with the condition that Buss must share the defense costs if the court so orders. Buss refused to reimburse defense costs that were not covered by the policy, prompting the insurer to file a lawsuit against him. The court's ruling has serious implications for the litigation insurance market in the state.

Best producers share many personality traits

Article Abstract:

Insurance agents require certain personality traits to be successful marketers of personal lines insurance. A survey of 165 agents divided into those selling to outside markets and those cultivating existing business found that successful agents demonstrated fundamental salesmanship skills such as empathy and abstract reasoning capabilities. The two different groups of salespeople surveyed were differentiated by their levels of ego-drive, ego-strength, assertiveness and buoyancy.

Malpractice claims are rising, but the buyer base is shrinking

Article Abstract:

A study by Conning & Co. of Hartford, CT, indicates that malpractice insurance policies are changing and a new type of underwriting called managed care liability has been developed in response to a shift from fee-for-service to managed care. Health care system changes are whittling the total number of buyers for malpractice insurance while increasing the potential exposure for malpractice losses by tens of millions of dollars.
