New laws may make employee health incentive plans illegal

Article Abstract:

Companies are implementing employee health incentive plans in order to cut on health costs and to encourage healthy habits among employees. However, some of these plans could be illegal under the Americans with Disabilities Act and some state laws. These plans can be made legal by giving financial incentives without medical exams, making medical exams voluntary by offering choices to the employees and giving educational programs to encourage employees to undergo health questioning and medical exams.

Is there an alternative to COBRA compliance?

Article Abstract:

The Consolidated Omnibus Budget Reconciliation Act of 1985 (COBRA) requires companies to pay employees health benefits not exceeding 102% of regular premiums. However, COBRA is continually expanding and workers eligible for it are also increasing. To cope with COBRA regulations, employers can choose to stop health programs but raise wages, discontinue COBRA rules but continue health benefits or tranfer the problem of health care to another party.
