New rules for nonqualified deferred compensation plans

Article Abstract:

Employers have to carefully review their employee compensation plans to determine which plans may be subject to the new rules. The American Jobs Creation Act of 2004 will significantly impact executive compensation practices and practitioners need to understand these rules in detail so that their clients succeed in avoiding the harsh tax consequences arising out of non-compliance.In actual fact, the rules that framed to regulate the perceived abusive compensation practices may become a trap for unwary employers. It is also felt that small business employers may face more problems than the large companies.
