A copyright bill stirs controversy

Article Abstract:

Librarians, attorneys, trade groups and publishers are divided in their opinions on H.R. 4426, which would preclude copyright protection for information used in citing cases and laws. Ralph Oman, U.S. register of copyrights, favors the bill. Robert A. Gorman, copyright law professor, feels that judgments made by such companies as West in selecting and organizing the court rulings that they report constitute protectable authorship. Steven J. Metalitz, general counsel to the Information Industry Assn, opposes it and feels it would diminish the public's options in accessing information.

Do not support 'privatizing' of copyright law

Article Abstract:

Shrink-wrap, click-here, and other variations on the mass-market license threaten to undermine existing protections afforded by traditional copyright law. The American Law Institute and the National Conference of Commissioners on Uniform State Laws are proposing a new article 2B of the Commercial Code which would make mass market licenses enforceable. The enforceability of the mass-market licenses will ultimately privatize American copyright law.
