The antitrust economics of credit card networks

Article Abstract:

Two recent cases considered whether the rules and coordinated activities of credit card joint ventures constituted agreements that reduced competition. In National Bancard Corp. v. VISA U.S.A., Inc., the court supported the defendant's position that the relevant market included all payment systems and methods. In SCFC ILC, Inc. v. VISA U.S.A., Inc., the appeals court ruled that VISA could not have market power because it is a joint venture of thousands of member banks that are competitors. In assessing potentially collusive behavior, entry and fee structure must also be considered.
