ABA eyes hardball play

Article Abstract:

The American Bar Assn's Section of Litigation is taking an unusually thoughtful approach to studying courtroom incivility and so-called hardball litigation tactics. Under section chair Larry Fox's leadership, the study will bring together two lawyers, one senior and one junior, from each of ten law firms in two cities. Social science observers with experience examining organizations will take part. The study is an effort to look beyond rules of procedure and ethics for other causes of incivility.

When the problems are fully considered, it is evident that reform has its limits

Article Abstract:

Correcting the public perception of attorneys as unethical and overly concerned with money will take effort and a recognition that much of the criticism has a grain of truth. Attorneys need to become better at managing files and at interpersonal relationships. This will make them both more effective at their business and less prone to client accusations of failure to resolve legal matters in an orderly manner and of duplicitousness.
