Consignments under current law and under the 1998 revisions to Article 9 of the Code

Article Abstract:

This article concerns the treatment under Uniform Commercial Code Article 9 of consignments which are generally treated under other code provisions. Article 9 is relevant to consignments due to conditions creating security interests. The application of current Article 9 and its 1998 revisions is discussed.

Security interests in investment property under current law and under the 1998 revisions to Article 9 Code

Article Abstract:

Secured transactions in general are governed by UCC Article 9, while secured transactions involving investment property are controlled by Section 9-115 as revised in 1994. New revisions drafted in 1998, with a suggested effective date of July 1, 2001, will affect secured transactions of investment property. However, the essential principles of the 1994 amendments will not be changed. Important points for practitioners include the need to choose the proper method of perfecting security interests.

Accounts, chattel paper, instruments and general intangibles under current law and under the 1998 revisions to Article 9 Code

Article Abstract:

This article examines the changes wrought by the revisions to Article 9 of the Uniform Commercial Code pertaining to the use of various kinds of property as collateral and which will take effect on July 1, 2001. Relevant points include how the changes will affect the use of accounts, chattel paper, instruments, and general intangibles as collateral, and the new rules regarding the perfection of security interests in property secured with collateral.
