Adolescent workers and sexual harassment

Article Abstract:

The legal risks to the employer posed by the possibility of sexual harassment of teenage workers are discussed. Definitions of the legal autonomy of minors to make their own decisions reached by both legislatures and courts are inconsistent. The Supreme Court's Burlington Industries and Farragher cases found employers vicariously liable for supervisor behavior.

Strange bedfellows: the Fair Credit Reporting Act and workplace investigations

Article Abstract:

The authors discuss the unintended consequences of the intersection of the Equal Educational Opportunities Act's guidelines for investigating claims of workplace sexual harassment with the mandate of Fair Credit Reporting Act for protecting the privacy rights of consumers. Advice on how employers can manage the dilemma is provided.
