After Adarand

Article Abstract:

The US Supreme Court's ruling in Adarand Constructors v.Pena that federal affirmative action programs must meet the standard of strict scrutiny has thrown these programs into turmoil. Critics of affirmative action programs predict their abolition or drastic reduction, while supporters emphasize the range of judicial opinion and say affirmative action can often meet the new standard. Many recent programs emphasize flexibility and address specific barriers to disadvantaged groups, but their viability remains uncertain.

GM cover-up charged in truck case; company to probe claim that lawyers shredded fuel-tank safety files

Article Abstract:

A Georgia case was the latest in a 20-year series of products liability suits against General Motors (GM) for accidents resulting from explosions of GM pickup trucks' sidesaddle gas tanks on impact. The trial featured testimony from a GM engineer stating the company had known since 1980 that the truck's design was faulty. Another engineer testified that GM legal staff destroyed damaging evidence when the first truck suits were filed. GM claims jury emotion fueled the $105.2 million verdict and plans to appeal.
