Who gets to appoint ALJs? Treasury Dept. case raises the issue for 1,000-plus judges

Article Abstract:

Issues are discussed regarding the bearing of the constitutional appointments clause on the appointment of administrative law judges (ALJs) by the Office of Thrift Supervision. The Supreme Court will soon review a DC Circuit case holding that the banking agency ALJs present no appointment clause problem because they are employees rather than inferior officers.

Will justices answer the abortion question?

Article Abstract:

The US Supreme Court has agreed to hear arguments on the constitutionality of a Pennsylvania abortion law in Planned Parenthood of Southeastern Pennsylvania v Casey, which some say opens the way for the justices to overrule Roe v Wade. Not everyone agrees on the meaning of 'overrule,' since the law in question is less restrictive than the one in Roe. However, the 3d Circuit found that the Supreme Court had abandoned the Roe standard of strict scrutiny of regulations limiting the fundamental right to abortion.

An emboldened majority breaks ground: although the center wavered, the court's rulings had a big effect on race, religion and federalism

Article Abstract:

The Supreme Court took a sharp conservative turn in its 1995 term, though many 5-4 splits indicate the fragility of coalitions on either side. Chief Justice Rehnquist and Justices Scalia and Thomas usually joined together, often with Justices Kennedy and O'Connor, in a term replete with closely watched cases. The court checked federal power in several rulings that showed a philosophical break within it, notably over race-related issues. The First Amendment triumphed over other issues in most cases.
