Badwill

Article Abstract:

As some trademarks have positive associations for consumers, i.e. goodwill, others have negative associations, or badwill. In the present state of trademark law, producers can simply change trademarks to avoid consumer badwill. Greater protection for consumers can be provided if trademark law is changed to make it more difficult for producers to avoid trademark badwill.

A caution about recent trends in ethics compliance programs

Article Abstract:

The fines and penalties as per the latest amendment are very harsh and the corporations need to be cautious enough. The sort of monitoring and verification that was urged by representatives of the U.S. Sentencing Commission is antithetical to the moral idealism of the guidelines as originally formulated.

The good, the bad, and their corporate codes of ethics: Enron, Sarbanes-Oxley, and the problems with legislating good behavior

Article Abstract:

Recent financial scandals have caused the passage of new laws designed to ensure disclosure of corporate codes of ethics.? However, these laws may do more harm than good.? They will not deter corporate wrongdoers, but honest executives may be tempted to weaken codes in order to avoid negative publicity.
