Benlate winners must try again: Fla. judge orders retrials, citing victors' misconduct

Article Abstract:

Dade County Judge Jonathan Colby on May 9 granted new trials in two cases over the DuPont fungicide Benlate 50 DF - cases over which he presided in 1993, 1994, and 1995. In a case brought and won by Claire Sidran, he rebuked her attorney, Edwin Ratiner of Ratiner & Glinn, citing many improper statements. In another case brought and lost by Native Hammock Nursery, he said he should have allowed certain evidence to be presented at the trial, and cited threatening conduct by a DuPont scientist.

Nicaraguans say they're not paying

The federal district court case All American Trading Corp v Cuartel General Fuerza Aerea, Guardia Nacional de Nicaragua arose from the failure of the current Nicaraguan government to pay debts incurred by the Somoza regime. All American Trading Corp was a substantial creditor who finally, in frustration over nonpayment, seized two Nicaraguan aircraft which had flown to the US. Nicaragua alleges a violation of the Foreign Sovereign Immunities Act/

Florida starts up a school for lawyers who stray: program centers on rescue of those committing minor infractions - not felonies

Article Abstract:

The Florida Bar has launched a course to help lawyers whose poor self-management threatens to harm their clients. The school, approved in 1994 by the FL Supreme Court, is not open to those who have lost a client's rights or who are dishonest or felonious. FL Bar staff member Paul Remillard runs the day-long classes, first held on Apr 12 in Tampa, which cost students $750, or as much as a fine for a minor infraction.
