Campaign 2000 focus is 'judicial activism;' but critics of right and left disagree on its definition

Judicial activism is discussed as a major theme of the presidential race for 2000. Which judge to nominate for any vacancy on the US Supreme Court during the next presidential term is a key campaign issue and has also added to the judicial activism discussion.

Abortion rights activists see hostile Thomas

Article Abstract:

Abortion rights activists fear Clarence Thomas' recent opinions on the First and Eighth Amendments demonstrate an insensitivity to personal rights which will hurt them in upcoming Supreme Court cases. Thomas' dissents in Hudson v McMillian and Dawson v Delaware, and his alignment with Roe v Wade foe Antonin Scalia have left abortion rights advocates with little hope of influencing him through amicus briefs.

Beyond 'Daubert'- court hears 'Kumho;' at stake is the very definition of who qualifies as an expert witness and may testify in federal court

Article Abstract:

The Supreme Court developed standards for admitting scientific expert evidence and in Kuhmo Tire Co. v. Carmichael may decide whether these apply to nonscientific expert evidence, that based on "skill or experience-based observation," as well. The federal circuits are split deeply on Daubert's application outside the hard sciences and the amendment to Federal Rules of Evidence 702 does not distinguish between scientific and other kinds of expert evidence, recognizing that each field has its own ways for determining an expert.
