Biotech patenting issues raise ethical concerns; strong patent regime for human genome research may balance public and private interests

Article Abstract:

Patenting promises to be the best form of protection for discoveries and products resulting from human genetic research. Scientists' current task is to determine which gene fragment or sequence yields particular proteins, with implications for both protein manufacture and gene therapy. This research could yield benefits rivaling those of electricity. However, companies are hesitant to invest the time and money needed without guaranteed protection. Sui generis, trademark, and copyright protection all have drawbacks.

Article Abstract:

Patenting of some new bioinformatic tools being developed to store and manipulate biotechnology industry data is discussed. A patented bioinformatic invention can also be sold or licensed to other biotechnology companies, especially if a comparable product is not available. Such patents often require collaboration between software patent specialists and scientific patent specialists.
