Cafeteria plans need to harmonize with FMLA mandates

Article Abstract:

The IRS has issued guidance on how to reconcile the provisions of the Family and Medical Leave Act of 1993 with payments to cafeteria benefit plans. An employee taking leave under the FMLA may opt to end coverage under a cafeteria plan or continue it with or without paying premiums. An employee who returns to work after revoking coverage or not paying premiums must be allowed to resume coverage under the plan.

The invention of health law

Article Abstract:

US courts have been inventing a health law which has as its goal the maximization of benefits for money spent. Unfortunately, based on the status of present knowledge, this model is unworkable. A model which takes into account the inherent conflicts between different goals of health care policy would be superior.

Article Abstract:

The changes and threats to public health insurance programs pose challenges to adequate health-care for people living with HIV/AIDS. However, the regulatory changes defining 'HIV specialists' in California could improve care for people living with HIV/AIDS who obtain their healthcare from managed-care plans.
