Changing the venue menu

Article Abstract:

Changes of venue often happen in the hope that justice will be better served in a town far from where the crime was committed and all the passions and publicity which accompanied the crime. Former attorney Fred Tokars was eventually sentenced to life in prison without parole for the contract murder of his wife. The murder was committed in Atlanta, but the trial was moved to the little town of La Fayette, GA. The decision to change venue outside the reach of the Atlanta media market caused a bill for Cobb County of $312,000, which may be the highest in county history.

Witchcraft murder defense fails; judge bars expert testimony on defendant's belief in victim's supernatural powers

Article Abstract:

Celerino Galicia's attorneys have failed in their attempt to use a witchcraft defense to explain why he murdered his girlfriend. The attorneys claimed that Galicia was a believer in 'curanderismo,' or Mexican folk healing, who thought his girlfriend was a witch who had cast a spell on him. Some observers say the witchcraft defense is a version of the insanity claim with no medical evidence to support it, while others see an increasing trend of cultural defenses.

New trial in clerk's murder; Oklahoma high court says state withheld evidence

Article Abstract:

Oklahoma death row inmate Adolph Munson has gained a new trial on charges of kidnapping and killing a convenience store clerk. The ruling by the Oklahoma Court of Criminal Appeals mentioned substantial exculpatory evidence that was kept out of the original trial. The lower court ruling reversing Munson's conviction and ordering a new trial was unprecedented in an Oklahoma capital case.
