Circuits split on regulators' S&L malpractice claims

Article Abstract:

A Jun 1992 decision by the 9th Circuit Court of Appeals and one by the 5th Circuit in Aug 1992, conflict over the issue of whether the Federal Deposit Insurance Corp (FDIC) may sue lawyers in a case in which the bank for which it is receiver was estopped from bringing an action. The 9th Circuit ruled that the bank was a separate entity from its owners and, even had the bank been estopped from bringing an action, the FDIC was not. The 5th Circuit held that the owner and bank were one, and since the FDIC 'steps into the shoes' of the bank, it cannot sue.

SLAPP suits continue in high gear; a pair of first

Article Abstract:

Strategic lawsuits against public participation (SLAPP) have been studied by George W. Pring and Penelope Canan, co-directors of the Political Litigation Project. The two have identified approximately 500 such actions. Put more simply, this acronym applies to actions in which people are sued after taking on a company or government agency. By 1991 Pring and Canan investigated 228 SLAPP actions resulting from public policy pronouncements in which 1,464 people and 409 groups were sued.

Claims continue, business booms

Article Abstract:

The Persian Gulf War has generated a variety of lawsuits as it resulted in contracts being broken, property damage, and a variety of political issues being joined. Many cases involve claims against Iraq through the United Nations Compensation Commission. Other legal work is required to establish new contracts to replace disrupted relations, as well as for rebuilding Kuwait's damaged petroleum industry. The social issues range from media censorship to anti-war protests.
