Civil settlement during rape prosecutions

Article Abstract:

An analysis of how pretrial civil settlements of rape cases, which involve the dropping of criminal charges, weakens rape law enforcement is presented. A possible remedy for this, by interpreting witness tampering laws to prohibit the use of such settlements to influence rape victims to drop charges, is also explored.

Civil banishment of gang members: circumventing criminal due process requirements?

Article Abstract:

The author analyzes the due process implications of a Cicero, Illinois ordinance that allows gang members found to be engaging in gang-related activity to be ordered to leave town and face severe fines if they returned.
