Tale of 2 states, four hearts and one prized baby; as two sets of parents vie for Jarrett, courts split over jurisdiction, doctrine

Article Abstract:

A legal custody battle over an adopted baby pits the adoption-friendly courts of New York against those of Pennsylvania, which strongly favor biological parents' rights. The case is complicated by the birth mother's failure to inform the father that she was pregnant. The adoptive parents, a New York couple with a stable marriage and a moderate income, filed in a New York court for custody when the baby was seven days old, one day before the mother filed in Pennsylvania. The Uniform Adoption Act, a model rule, could have prevented the struggle.

Social security fee proposal draws protest

Article Abstract:

Proposed changes by the Social Security Admin in how lawyers who represent disabled claimants before it get paid are under attack. The SSA plans to stop withholding attorneys' fees from clients' awards and lower the cap from the present $4000 to $2500, a figure some in the agency say is too low. The SSA says, however, that it is streamlining the process so it will go faster, and that it now spends $26 million annually administering the withholding process. Some lawyers say the changes are an attack on their profession.
