Consumer contracts and jurisdiction, recognition and enforcement of judgments in civil and commercial matters

Article Abstract:

The differences between the consumer contracts and general contracts based on the interpretation of the first paragraph of Article 13 of the Convection of 27September 1968 on Jurisdiction and Enforcement of Judgments in Civil and Commercial Matters, also known as, the 'Brussels ConventionE are discussed. The creation of the three-step test aids the national courts in deciding whether the contract is a consumer contract or not and in deciding if the buyer benefits from the exceptional protection provided by the Brussels Convention.

Encouraging enterprise and rebalancing risk: implications of economic policy for regulation, enforcement and compensation

Article Abstract:

Economic policies agreed upon by the European Union and the British government for better business performance is presented. A suggestion for a policy linking enforcement and compensation is also put forth.
