A class action model for antitrust damages litigation in the European Union

The class action litigation model in the U.S. especially the legal and economic structure is discussed by researching the class certification and class action. The EU Commission has published a Green Paper that has proposals for the adoption of private antitrust damages litigation in the European Union.

Draft Commission Guidelines on the assessment of non-horizontal mergers: do they "defend" the efficiency defence?

Article Abstract:

The draft guidelines of the Draft Commission aimed at clarifying the assessment of the vertical and conglomerate mergers under the new EC Merger Regulation is presented. The Draft Guidelines add to concept of the efficiency defence in the case of non-horizontal mergers.
