Courts begin to rule against acts of circumvention; two recent cases find violation of Sec. 1201 of DMCA without actual infringement of works

Article Abstract:

The Digital Millennium Copyright Act's (DMCA) anti-circumvention provisions, created to allow content owners to protect electronic copies of their works with technical measures, and the latest case law are discussed. The courts have ruled that content owners can sue those who undermine such measures without showing infringement. Corporations making the software to protect copyrights can also file suit without showing infringement.

DMCA safe harbor provisions

Article Abstract:

Issues regarding the safe harbor provisions in the Digital Millennium Copyright Act of 1998 are discussed, and their aim was to make sure service providers would make the necessary investment in the Internet's expansion without fears of uncontrollable copyright liability. The Napster case is also discussed at some length.
