Criminal law; eyewitness IDs

Article Abstract:

Concern about the reliability of eyewitness testimony is discussed. According to one study, 50% of all wrongful convictions result from false identifications, and the question is what steps courts should be taking to address the problem. Among the choices are to suppress overly suggestive identifications, give special jury instructions against relying on eyewitness identification and have experts testify about this method's unreliability.

Criminal law; overzealous counsel

Article Abstract:

Rulings holding criminal defense lawyers in contempt for overly zealous representation are discussed. Both state and federal courts have issued such sanctions against defense and government counsel. Insufficient evidence that the lawyers' conduct was intentional may mean appellate courts do not agree with a contempt finding.
