Article Abstract:

Changes to criminal justice administration will be many by the year 2000 and will include changes in criminal laws, both the Federal Rules of Criminal Procedure and the Federal Rules of Evidence, and in procedures for the conduct of criminal trials. The Rules Committee is seeking a more level playing field between defendants and victims, particularly in self-defense cases. A change likely to have great impact is one in Federal Rule of Criminal Procedure 24 would permit the substitution of alternate trial jurors.

Criminal law; the necessity defense

Article Abstract:

Criminal rulings issued in 1999 indicate that the necessity defense may be making a comeback. The US Court of Appeals for the 9th Circuit ruled in U.S. v. Oakland Cannabis Buyers' Cooperative for a plausible necessity defense overruled an injunction barring the club from providing cannabis to the seriously ill for medical purposes.
