Custody case brings calls for reform; advocates for children, birth parents disagree on need for new adoption laws

Article Abstract:

The adoption case of DeBoer v Schmidt continues with a Michigan appellate court order on Mar 29, 1993 that adoptive parents Jan and Roberta DeBoer must return Roberta, whom they have raised the better part of her life, to her birth parents Cara and Daniel Schmidt. This decision agrees with two Iowa court rulings in the birth parents' favor in 1992. This dispute began with the birth mother's admission that she had lied about paternity and that the birth father had never consented to the adoption.

Surrogacy contract upheld; Calif. Supreme Court says such agreements don't violate public policy

Article Abstract:

The California Supreme Court has ruled that genetic parents Mark and Crispina Calvert's rights to their baby prevail over those of surrogate mother Anna Johnson, while also stating that surrogate agreements do not violate public policy. The court's legal theory was that the parties' intent determines who is legally a child's parent. Some 15 states regulate surrogacy, although seven of these make no provisions for gestational surrogacy.

Boy wants "divorce" from parents; suit seeks to sever parental ties, pave the way for adoption by foster caretakers

Article Abstract:

An 11-year old boy known in court filings only as Gregory K. is suing his natural parents to end his relationship with them so that his foster parents can adopt him. His natural parents were both abusive and he also spent time being shunted from one foster home or shelter to another. His suit is seen as a test case of children's constitutional rights to a voice in custody decisions about them.
