A circumstantial case: low-tech typewriter may help convict unabomber suspect

Article Abstract:

Powerful circumstantial evidence, including the typewriter believed used to write the Unabomber manifesto, may lead Theodore J. Kaczynski to enter a plea agreement to avoid the death penalty. Agents for the Federal Bureau of Investigation have also found bomb-making materials and other evidence in Kaczynski's remote cabin linking him to a 17-year spree of 16 mail bomb attacks that killed three and injured 23 others. Kaczynski's mental state and the relatively low number of victims killed weigh against the penalty.

Hardly hardball; prosecutors in most of 22 states studied are not using three-strikes laws against repeat offenders

Article Abstract:

A study by the Campaign for an Effective Crime Policy showed prosecutorial reluctance to use the three-strikes laws. Several states have not issued any sentences under these laws, and other states resort to them rarely. The only exception is California, which has issued 15,000 such sentences. This prosecutorial reluctance can be ascribed to reasons ranging from a desire for fairness to a habit of using other tough ways of sentencing. Sometimes the three-strikes laws are used as a threat in plea bargaining.
