Data bases are a boon to litigators: computer files of responsive documents can get results in large cases when used properly

Article Abstract:

The data base is an enormously powerful tool to help manage documents in complex litigation but it can also deceive the unwary into trying to replace the actual documents with reference to the data base. Modern desktop computers allow the compilation and rapid sorting of data bases containing hundreds of thousands of records by any number of criteria, finding nearly all relevant documents or only a few closely related to the issue. The coding procedure and schemes of topic creation are discussed.

A new battlefield: masters and experts

Article Abstract:

US judges are heeding the Supreme Court's signal in the Daubert and General Electric rulings and using more experts in trials involving scientific evidence. Judge Thomas Penfield Jackson's appointment of a special master in the Microsoft antitrust case is a small beginning toward replacing scientifically illiterate juries and judges with court-selected experts in litigation involving complex evidentiary issues.
