Development in the law: international criminal law

Article Abstract:

Developments and achievements in international criminal law are assessed. Topics include the effect of international tribunals, including the International Criminal Tribunal for the Former Yugoslavia and the International Criminal Tribunal for Rwanda, on the development of international humanitarian law. Individual and corporate liability, and domestic liability for violations of international law are also examined.

Almost private remedy: foreign party suits and the U.S. antitrust laws

Article Abstract:

The controversy surrounding the Foreign Trade Antitrust Improvements Act's impact on the right of foreign consumers to institute antitrust actions under US law is examined. The influence of the US Supreme Court's 1978 Pfizer v. India decision, allowing suit by foreign plaintiffs, is discussed.

Constitutional risks to equal protection in the criminal justice system

Article Abstract:

The author addresses the problem of providing proper remedies for equal protection violations in the criminal justice context. The difficulties of establishing a particularized harm when such harm involves systemic racial discrimination in the administration of criminal justice are analyzed.
