Can't say that - here's why; get more objections sustained by stressing the legal basis

Article Abstract:

The point of making an objection is to get it sustained at trial rather than on appeal, as most appellate judges call incorrect evidence rulings 'harmless error.' Giving the legal basis for an objection simply and directly and without being argumentative is key. The best evidence rule, ambiguous questions, calling for speculoation, and showing that business records were made with a view toward litigation are all good reasons for objections.

Don't be locked out; the right strategy can open doors to evidence that might otherwise be inadmissible at trial

Article Abstract:

Evidence can be unlocked at the pretrial stage and lawyers need not wait until trial, and lawyers should be direct, simple and to the point in doing this. A possible strategy in a case for negligent injury of a pedestrian would be negligent hiring of the defendant, and a count of negligence in a case against the manufacturer of a defective product might do the trick. Other examples are given.
