Dwindling judicial resources; chronic underfunding leading to delays, reduced services, shutdowns

Article Abstract:

The chronic underfunding suffered by both the civil and criminal branches of the federal courts is imperiling the availability and quality of justice in the US. Half of the states are also faced with budget cuts to their court systems. The bar can help alleviate matters by encouraging things like alternative dispute resolution, but such measures can never suffice and the government must remember its duty to adequately fund the judicial system.

The erosion of indigent rights; excessive caseloads resulting in ineffective counsel for poor

Article Abstract:

An ABA Criminal Justice Section report has found that the quality and availability of indigent defense is deteriorating seriously. Both the ABA and state bars need to take steps to reverse this situation. This might include reclassifying some crimes so that public defenders can concentrate on the truly major ones and supporting an increase in funds for legal assistance to the poor.
