E-litigation; linking to lawsuits

Article Abstract:

The area of World Wide Web sites and hyperlinking have led to many suits, usually on copyright infringement grounds. Drafting link agreements has become a new legal subspecialty, as many Web site owners now use the precaution of seeking permission before linking to another's site. Web site suits have also challenged framing of the Web site.

After 'Feltner,' how will juries decide damages? Case that rules 7th Amendment requires jury trial for copyright statutory damages leaves gaps

Article Abstract:

The US Supreme Court granted certiorari in Feltner v. Columbia Pictures Television, Inc. to consider whether the right to a jury trial comes from a. 504(c) of the Copyright Act or the Seventh Amendment when the copyright owner agrees to recover statutory damages. The court decided that such a right comes from the Seventh Amendment.

Termination looms in 2013; authors' ability to end grants in works from 1978 on will affect many IP owners and licensees

Article Abstract:

The right of some copyright authors, starting in 2013, to terminate any past transfer or license of rights is discussed. The applicable law is 17 USC 203 and 304(c) of the Copyright Act of 1976.
