EPA employees prevail in a free-speech suit

Article Abstract:

The DC Circuit Court overturned an EPA honoraria ban that only allowed employees to receive lodging and expenses for authorized speeches when it was used to prevent two whistle-blowers from being compensated. The Court found that the ban was a violation of Hugh Kaufman and William Sanjour's free speech rights based on a US Supreme Court ruling in United States v. National Treasury Employees Union. The ruling determined that compensation for officially sanctioned travel could continue but that dissenting employees could be compensated as well.

According to testimony, Chevron offered to hire Exploration Technologies contingent on the firm's termination of its work for Kennedy Heights. Chevron contended it rescinded the offer after counsel discovered the potential conflict of interest.
