Employee benefits and the ADA

Article Abstract:

The rules available to define the implementation and application of the Americans with Disabilities Act pay little attention to the impact on employee benefits. The Act states that any change in benefits that affects all employees will not fall under the Act's discrimination clauses so that employers' benefits administration can still be based on risk assessment. However, the interpretation of the Act will be established by courts and the EEOC and so employers may end up having to justify all benefits decisions that end up affecting disabled persons.

Employee benefit planning: prescription drug plans

Article Abstract:

Increasing numbers of medical plans have separated prescription drug plans from their services since the 1980s, giving rise to pharmacy benefit managers (PBMs). People in these positions develop networks to dispense drugs; profile physicians, patients, and pharmacies, and develop disease management programs that assist in case management. PBMs have generally supported integrating formularies into prescription drug plans.

The pension simplification act

Article Abstract:

Recent tax changes have simplified pension plans by providing more options for employers and homemakers and eliminating excise taxes. They also eliminate five-year averaging, change annuity taxation, require distributions at 70 1 2 years of age and cut the $5,000 death benefit exclusion. The advantages and disadvantages to the new savings incentive match plan for employees are provided.
